Question : Public Procurement Guidelines


(a) whether the Government has released any public procurement guidelines including the guidelines for Government e-Market (GeM) and if so, the details in this regard; and

(b) whether the guidelines take into consideration the National Guidelines on Responsible Business Conduct (NGRBC) released by the Government and if so, the details thereof and if not, the reasons therefor?

(a) & (b): The Department of Expenditure in the Ministry of Finance has stated that it has issued the General Financial Rules (GFRs), 2017, which are general guidelines to be followed while dealing with public finances including public procurement. Rule 149 of the GFRs, 2017 mandates procurement by Ministries and Departments of Goods or Services available on Government e-Marketplace (GeM) from GeM. Department of Expenditure has also issued Manual of Procurement of Goods 2017, Manual of Procurement of Consultancy and Other Services 2017 and Manual of Procurement of Works 2019, which also act as guidelines in public procurement including procurement through GeM. Department of Expenditure also issues guidelines on public procurement, as and when such a situation arises. NGRBC are prepared by the Ministry of Corporate Affairs (MCA) and while formulating GFRs and procurement manuals, the Department of Expenditure had consulted Ministry of Corporate Affairs.
