Question : Notice to NGOs

(a) whether the Government has issued direction/notice to all the NGOs in the country to submit the details of donations and financial assistance received from foreign countries;

(b) if so, the details thereof;

(c) the number of such NGOs issued notices and the number of NGOs who have submitted the said details to the Government;

(d) whether it is fact that the personnel department had returned the notices issued to about 500 NGOs in Andhra Pradesh stating that their addresses are wrong; and

(e) if so, the reaction of the Government thereto?

(a) to (e): The Ministry of Home Affairs is mandated to administer the Foreign Contribution (Regulation) Act, 2010 (FCRA 2010), for regulating the receipt and utilization of foreign contribution by the associations/NGOs. As per Rule 17(1) of Foreign Contribution (Regulation) Rules 2011 (FCRR 2011) every person who receives foreign contribution is required to submit Annual Accounts for each financial year within a period of nine months from closure of the year i.e. by 31st December.

Foreign Contribution (Regulation) Act, 2010 (FCRA) and Foreign Contribution (Regulation) Rule, 2011 (FCRR) came into force with effect from 01.05.2011. Since then, notices were issued to around 21,000 associations in 2011 and to 10,343 associations in 2014 respectively for not filing annual returns continuously for three years.

Out of the notices issued during 2014, 226 associations have submitted the satisfactory reply along with all the relevant details.

After giving them adequate opportunity and following due process, registration of 4138 associations was cancelled in July 2012 and of 10,117 in March 2015 respectively.

Out of the notices issued during 2012 and 2014, 4138 and 510 notices respectively have been returned by the postal authorities as undelivered.
