Question : Incidents of Lynching

(a) whether incidents of lynching/ lynching by mob are reportedly on the rise in the country and if so, the details thereof and the reasons therefor;

(b) the total number of such cases reported, persons killed/injured, persons arrested and the action taken against them during each of the last three years and the current year, State/UT-wise;

(c) the total number of such cases related to cow vigilantes, cow trade/ trafficking reported and the action taken in this regard during the said period, State/ UT-wise;

(d) whether the Government has any proposal to bring a stringent law against mob lynching and if so, the details thereof; and

(e) the other measures taken by the Government to stop such cases in future?

Statement referred in Lok Sabha Starred Question No. *130 for reply on 25th July, 2017 regarding ‘Incidents of Lynching’

(a) to (c): National Crime Records Bureau (NCRB) maintains data on offences promoting enmity between different groups on ground of religion, race, place of birth etc. (Section 153A & 153B of IPC) and State/UT-wise cases reported under offences promoting enmity between different groups (Section 153A & 153B of IPC) is at Annexure. However, NCRB does not maintain data on cases relating to cow ‘vigilantes’, cow trade and trafficking.

(d): No such proposal is under consideration at present in the Ministry of Home Affairs.

(e): ‘Police’ and ‘Public Order’ are State subjects under the Seventh Schedule to the Constitution of India. The responsibilities to maintain law and order, protection of life and property rest primarily with the respective State Governments. The State Governments are competent to deal with such offences under the provisions of law.
