Question : ST Status

(a) the number of tribes which have applied for Scheduled Tribe (ST) status in the last three years and the number of tribes which had been granted ST status before 2014;
(b) whether many tribes were not granted ST status owing to certain spelling mistakes or differences in pronunciation and if so, the details thereof;
(c) the number of such tribes which were brought under the ST list after 2014 and the number of such tribes whose names are under consideration for updation in the ST list; and
(d) the total number of tribes in the ST list, State-wise?

(a): The proposals have been received from different States for inclusion/modification of 10 communities in Scheduled Tribes (ST) list in their respective States in the last three years (upto 31.03.2022). The ST Status has been given to the communities of Puducherry, Karnataka, Arunachal Pradesh, Jharkhand and Tripura after the year 2014, a list of these communities is attached at Annexure-1. All other ST communities except those included in the ST list after 2014 were included in the list of Scheduled Tribes before the year 2014, a list of the communities given Scheduled Tribes status before 2014 may be seen at Annexure-2 in the State-wise list of STs.

(b): Hon''ble Supreme Court in its decision dated 28-11-2000 in case No. 652 of 2000 (Civil Appeal No. 2294 of 1986) State of Maharashtra Vs. Milind regarding order issued under Article 341 and 342 of Constitution had held (refer Para 29 of the decision) which inter-alia states as under: -
“STs Order must be read as it is. It is not even permissible to say that a tribe, sub-tribe, part of or group of any tribe or tribal community is synonymous to the one mentioned in STs Order, if they are not so specifically mentioned in it.”
(c): The tribes which were brought under the ST list after 2014 may be seen at Annexure-1. Further, the Government of India on 15.6.1999, and further amended on 25.6.2002, has approved the modalities for deciding the claims for inclusion in, exclusion from and other modifications in the Orders specifying lists of Scheduled Tribes. According to these modalities, only those proposals which have been recommended and justified by the State Government/UT Administration concerned, can be processed further. Thereafter, it has to be concurred with by the Registrar General of India (RGI) and the National Commission for Scheduled Tribes (NCST) for consideration for amendment of legislation. All actions are taken as per these approved modalities.
(d): State-wise ST list is attached at Annexure-2.
