Question : Conduct of Healthcare Professionals

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether the Government has taken note of unethical professional misconduct on the part of medical professionals such as accepting commissions, gifts, travel facility, hospitality, cash or monetary grants and other favours from pharmaceutical and allied health sector industry and if so, the details thereof;

(b) the number of complaints received, enquiry conducted, action recommended and punishment awarded to the medical professionals for the unethical medical practices during each of the last three years and the current year, State/UT-wise;

(c) whether the Medical Council of India (MCI) has recently blacklisted some doctors and has put their names on its website, if so, the details thereof and the reasons therefor;

(d) whether the Government proposes to take fresh measures including setting up of a council to regulate conduct of healthcare professionals and if so, the details thereof; and

(e) the present status of the Allied and Healthcare Professionals Central Council (AHPCC) bill in this regard?

(a): Medical Council of India (MCI) or the appropriate State Medical Council have been empowered to take disciplinary action against a doctor for violation of the provisions of Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002. As and when complaints are received against doctors for violation of code of ethics, the State Medical Council or MCI conducts inquiry into such violations and takes necessary action.
(b): As per information furnished by MCI, the details of complaints/appeals received during the last three years is as given below:

As reported by MCI appeals are decided on case to case basis on merits of each case.


(c): Yes. MCI has blacklisted 110 doctors in Indian Medical Register for violating the provisions of Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.
(d) & (e) Yes. The draft Allied and Healthcare Professionals Central Council (AHPCC) Bill, 2015, is under consideration.
