Question : FAMILY COURTS



(a) the number of family courts functioning in various parts of the country, State-wise including Uttar Pradesh;

(b) whether the Government proposes to set up more number of such courts;

(c) if so, the details thereof, State-wise and location-wise; and

(d) the steps taken by the Government in this regard?

(a) As per the reports received, 233 Family Courts are operational in the country including Uttar Pradesh. A statement indicating State-wise number of Family Courts is enclosed at Annex.

(b)&(c) Under Section 3(1)(a) of the Family Courts Act, 1984, it is mandatory for the State Governments to set up a Family Court for every area in the State comprising a city or a town whose population exceeds one million. The Family Courts are set-up by the State Government in consultation with the respective High Court.

(d) Central Government provides financial assistance of Rs. 10 lakh per court to the State Governments as a one-time grant for the construction of the building of Family Court under Plan scheme and Rs. 5 lakh annually as the recurring cost under Non-Plan. Central Government has written to the State Governments from time to time to set up at least one Family Court in each district.
