Question : COMMERCIAL USE OF BUILDINGS

to the reply given to USQ No. 4766 dated December 19, 2000 and state:

(a) whether it is a fact that the Government have failed to initiate any action against the 65 buildings being used for commercial purposes and violation of building bye-laws;

(b) if so, the reasons therefor;

(c) if not, the details of the action taken thereon;

(d) whether any further studies have been conducted for violation of building bye-laws and the usages of buildings in South Delhi particularly in the Greater Kailash-I & II on the lines of South Extention in South Delhi to check massive commercialization of these areas;

(e) if so, the findings thereof; and

(f) if not, the reasons therefor?

(a)to(c): Action has already been initiated by Municipal Corporation of Delhi(MCD) for prosecution against 65 buildings in Greater Kailash-I under Section 347/461 of DMC Act, 1957 for using basement of these properties for commercial purposes in violation of Building Bye-laws.

(d)to(f): MCD has reported that no specific survey has been conducted by it to detect violation of building bye-laws in the said colony. It has further reproted that it initiates action as per provision of DMC Act as and when any case of violation is detected. During the current year in 17 cases action as per provision of DMC Act have so far been initiated in Greater Kailash-II. In the case of Greater Kailash-I, apart from initiating prosecution action in 65 cases, action against 22 more cases have been initiated under the DMC Act.
