Question : VIOLATION OF RTE ACT



(a) whether the Union Government is aware of violation in the implementation of Right to Education (RTE) Act by some State Governments across the country;

(b) if so, the details of complaints/representations received in this regard and action contemplated by the Union Government thereon;

(c) whether the Union Government has called a meeting of all the Education Ministers of the various States/UTs and given any clear cut directions on the implementation of the RTE Act; and

(d) if so, the details in this regard and further action Union Government proposes to take where violation in the implementation of RTE Act is committed by any of the State Governments UT?

(a) t`o (d): After enactment of the Right of Children to Free and Compulsory Education (P.TE) Act, 2009 all States have notified their State RTE rules for effective implementation of the Act. Sections 31 and 32 of RTE Act, 2009 provide for monitoring of child`s right to education and redressal of grievances in context of right to education, respectively. The National Commission for Protection of Child Rights (NCPCR) at national level and the State Commission for Protection of Child Rights (SCPCRs) at state level examine and review the safeguards for rights under the RTE Act, 2009 and inquire into complaints relating to child`s right to free and compulsory education to redress grievances on violation of RTE Act, 2009.

Complaints on non-compliance/violation to the provision of RTE Act, 2009 are immediately referred by the Central government to the concerned State Government/UT Administration for remedial action. The Central government reviews and monitors implementation of the RTE Act periodically with the States at different fora, including the State Education Ministers` Conferences, through school based data provided under Unified District Information System for Education (U-DISE). The Central government also releases an annual publication on State-wise progress under the RTE Act, which is available on the Ministry`s website.
