Question : Violation of Fee Collection at Toll Plazas

(a) whether the Government has noticed certain shortcomings in the agreements signed with the Private Companies for Toll Plaza Fees on National Highways (NHs) across the country during each of the last
three years and the current year;

(b) if so, the details thereof, NH-wise and the reasons therefor;

(c) whether the cases of violation of the National Highways Fees (Determination of Rates and Collection) Rules, 2008 by the said companies have come to the notice of the Government during the said period;

(d) if so, the details thereof, companywise and the reasons therefor along with the action taken/being taken by the Government against such companies so far;

(e) whether the Government proposes Uniform Toll Tax on NHs across the country; and

(f) if so, the details thereof along with the time by which it is likely to be implemented in the country?

(a) The contract agreement with the contractor for user fee collection is based on the standard document in practice and the fee applicable is as per the provisions in the amended National Highways Fees (Determination of Rates and Collection) Rules, 2008. Any issue/ violation is dealt on case to case basis under the ambit of Contract Agreements and is an ongoing process.

(b) Does not arise.

(c) & (d) The information is being collected and will be laid on the Table of the House.

(e) & (f) User fee is being collected across all fee plazas of National Highways uniformly by contractor/concessionaire as per applicable Fee Rules and Concession Agreement.
