Question : Naxal Encounter in Maharashtra

(a) whether Naxals were killed in an encounter in Gadchiroli district, Maharashtra recently, if so, the details thereof during the last five years and the current year, till date and the reasons therefor, State wise;
(b) the number of naxals/police killed, injured in such encounters State-wise;
(c) the number of fake encounters reported/along with the action taken thereon; and
(d) the corrective steps being taken by the Government to stop such fake encounters?

(a)& (b): 27 Left Wing Extremists (LWEs), including Milind Teltumbde, Member, Central Committee of CPI (Maoist), were killed in an exchange of fire (EoF)with Police under the jurisdiction of Police Station Korchi, district Gadchiroli, Maharashtra on 13.11.2021. Following the EoF, the Police recovered 29 weapons, including AK-47 Rifle–06, Underbarrel Grenade Launcher–01, SLR Rifle–09, INSAS Rifle–01, and .303 Rifle–03.

The number of LWEs killed during the exchange of fire with security forces and security forces killed, injured during the last 05 years and the current year, State-wise, is given at Annexure I.
(c)& (d):No case of fake encounter in the LWE affected States has been reported.
A strong constitutional and legal mechanism exists, which include National Human Rights Commission (NHRC) and State Human Rights Commission (SHRC), to prevent and deal with the case of fake encounter. NHRC has issued guidelines for conducting magisterial enquiries in case of death of a person in police action. The Hon’ble Supreme Court of India has also laid down a detailed procedure to be followed in investigation of a case of death of a person during police encounter for thorough, effective and independent investigation. These mechanisms and rulings are in addition to the provisions given in the criminal laws for registration and fair investigation of an offence.
