Question : Accidents at Workplace

(a)whether the incidents of death of workers in cases of fire, leakage of gas or bursting of cylinders and boilers have increased recently due to negligence in factories;
(b)if so, the details thereof along with the number of such incidents reported in private and public sector factories in the country including Rajasthan and Maharashtra during the last three years;
(c)the number of workers lost their lives in such incidents along with the type of action taken against the management/ owners of these factories State/UT-wise;
(d)whether the Government regularly monitors the security checks, safe working condition for the employees and other security related aspects in industrial units and factories;
(e)if so, the details thereof; and
(f)the State-wise details of the cases of security lapses registered during the last four years?

Factory Advice Service & Labour Institutes (DGFASLI) an attached office under Ministry of Labour & Employment, the state-wise details including the States of Rajasthan & Maharashtra, pertaining to the fatal injuries due to incidents of fire, gassing and explosions for both private and public sectors registered factories during the years 2014, 2015 and 2016 is given in Annexure-IA, Annexure-IB and Annexure-IC respectively. The specific data in respect of bursting of cylinder and boilers is not maintained.

The Government of India has enacted a comprehensive legislation i.e. the Factories Act, 1948, for taking care of the occupational safety, health & welfare issues of the workers employed in the factories registered under the Act. Further the Act and the State Factories Rules framed thereunder are enforced by the respective States/UTs. In case of violation of any of the provisions by the occupier and/or manager of such factories, penal actions are initiated as per the penal provisions under the Act. The details of violation/State-wise number of such prosecutions launched and convictions under the Factories Act, 1948 for the years 2014, 2015 and 2016 are given in Annexure II-A, Annexure II-B and Annexure II-C respectively.

(d) to (f): The State/UT Governments regularly monitors the safe working conditions by carrying out regular inspection for enforcing the provisions contained under Chapter-III: Health, Chapter- IV: Safety and Chapter-IVA: Provisions relating to Hazardous Processes in the registered factories under The Factories Act, 1948 and the State Factories Rules framed there under. In case of violation of any of the provisions by the occupier and/or manager of such factories penal actions are initiated as per the penal provisions of the Act. The details of violation and prosecution convictions launched as per State-wise details provided in part (a) to (c) of the reply.
