Question : CREAMY LAYER OF OBC .



(a) the present terms and conditions for determining creamy layer to exclude a family of backward class from the benefits of reservation under the Other Backward Classes (OBCs) category;

(b) whether the income from salary and agriculture of an individual has been excluded from the ceiling of Rs. 6 lakh annual income to determine the creamy layer and if so, the details thereof;

(c) whether the income of parents only is taken into consideration to determine the creamy layer of a family and if so, the details thereof;

(d) the existing criterion followed by the Government for revision of income ceiling to determine the creamy layer status of a family in the country;

(e) whether the Government has any proposal to enhance the ceiling of income to determine the creamy layer status of a family; and

(f) if so, the details thereof?

(a): The terms and conditions for determining creamy layer for Other Backward Classes (OBCs) have been laid in the Schedule to the Office Memorandum No. 36012/22/93-Estt(SCT) dated 8th September, 1993.

(b) & (c): For determining the creamy layer status, income of the parents and not of the individual is taken into account.

(d): The increase in the income limit to exclude Creamy Layer is in keeping with the increase in the Consumer Price Index.

(e) & (f): The income limit to determine the creamy layer had been raised from Rs.4.5. Lakhs to Rs.6 lakhs only in May 2013.
