Question : Over Speeding of Vehicles

(a) the details of the vehicles allowed to ply on National Highways;

(b) whether the Government proposes to install weighing machines, speed governors and CCTV cameras to measure over speeding and over loaded vehicles at NHs and flyovers;

(c) if so, the details thereof along with the mechanism adopted to fix speed limits on various roads;

(d) whether there has been any orders for fixing speed governors on commercial vehicles; and

(e) if so, the details and status thereof along with the action taken against the defaulters?

(a) The types of motor vehicles are defined under section 2 of the Motor Vehicles Act, 1988. As per Motor Vehicles Act, 1988 and Central Motor Vehicles Rules, 1989 there is no restriction on any motor vehicle to ply on National Highways.

(b) Ministry of Road Transport and Highways had issued notifications GSR 290(E) dated 15.04.2015 and S.O. 2687 dated 01.10.2015 regarding mandatory fitment of speed governor on transport vehicles. National Highways Authority of India (NHAI) proposes to install slow speed weigh-in-motion (WIM) systems and Static Weigh Bridges (SWB) at toll plazas on National Highways.

(c) This Ministry has notified S.O. No. 1997(E) dated 5th August, 2014 for fixing the maximum speed in kilometres per hour in respect of the different class of motor vehicles.

(d) Ministry of Road Transport and Highways had issued notifications GSR 290(E) dated 15.04.2015 and S.O. 2687 dated 01.10.2015 regarding mandatory fitment of speed governor on transport vehicles, enforcing uniform implementation across the country.

(e) Provisions regarding offences, penalties and procedure are contained in Sections 177 to 210 of Chapter XIII of Motor Vehicles Act, 1988 and rule 164 of Central Motor Vehicles Rules, 1989. Implementation of the provisions of Motor Vehicles Act, 1988 and Central Motor Vehicles Rules, 1989 come under the purview of State Transport Authorities and UT administrations.
