Question : REPATRIATION OF CVO



(a) the existing norms/rules laid down for appointment on deputation and transfer of Government Officers in various departments/ministries under the Government of India;

(b) whether instances of officers particularly vigilance officers on deputation, being repatriated to their parent Ministry/Department before expiry of their deputation period, have come to the notice of the Government;

(c) if so, the details thereof and the reasons therefor; and

(d) the steps taken by the Government to protect honest officers trying to check corruption?

(a): The appointment to a post including on deputation is made in terms of provisions of the applicable Recruitment Rules. The transfer of Government Officers in various departments/ministries is regulated by OM No. 6/8/2009-Estt (Pay-II) dated 17.06.2010 of Deptt. of Personnel & Training. Consolidated guidelines on deputation/foreign service for the members of the Organized Group ‘A’ and Group ‘B’ services of the Central Government have been issued vide OM No. AB-14017/2/2007-Estt (RR) dated 29th February, 2008. Para 1.2.2 of the guidelines provides the procedure to be followed for appointment to the post of CVOs. Similar deputation guidelines for All India Services have also been issued vide letter no. 14017/33/2005-AIS(II)(Pt.I) dated 28th November, 2007.

(b) & (c): Yes, Madam. Statement in this regard is annexed.

(d): Previous Sanction of the Government is required under Section 19 of the Prevention of Corruption Act, 1988 before launching of prosecution proceedings in a Court of Law for specified offences under the Prevention of Corruption Act, 1988. The recent enactment of the Whistle Blowers Protection Act, 2011 also provides protection to honest officers of the Government who blows the whistle against any corrupt practices.

Besides the above, the Central Vigilance Commission has also issued comprehensive circular vide no. 006/VGL/022 dated 28th March, 2006 for protection against victimization of officials of the Vigilance Units of various Ministries/ Departments/ Organisations.
