Question : FOREIGNERS IN INDIAN JAILS



(a) the total number of foreign nationals lodged in jails, country and State-wise;

(b) whether it is a fact that many of these foreign nationals have completed their sentence but are still languishing in jails for various reasons;

(c) if so, the details of foreign prisoners who have completed their jail terms and are still Lodged in jails and the reasons therefor, State-wise;

(d) whether the Government has taken up their case with the concerned Embassies/ High Commissions so that these nationals could be sent back to their countries;

(e) if so, the details thereof and if not, the reasons therefor; and

(f) the other measures taken by the Government in this regard?

(a): As per the data compiled by National Crime Records Bureau (NCRB) at the end of year 2013, a total of 6747 foreign prisoners were kept in various jails of the country. A State/UT wise statement of foreigners lodged in the jails of India is enclosed at the annexure.

(b) to (f): “Prisons” is a State subject as per entry 4 of List II of the Seventh Schedule to the Constitution of India. Therefore, the administration and management of prisons is primarily the responsibility of the State Governments. Data is not compiled centrally in this regard except for Pakistani nationals and as per information available, presently there are 41 Pakistani prisoners lodged in the various jails, awaiting their repatriation due to non-confirmation of their nationality.
