Question : Seats under Right to Education

(a) whether the Government proposes to include students between 0-6 years and 14-18 years
under RTE Act;
(b) the details of the quota seats available & filled under Section 12(1)(c) of the RTE Act,
State and district-wise;
(c) the measures taken/being taken to reduce the burden of other costs like uniforms, books,
transport, trips, non-tuition fees on parents of EWS students taking admission in private
schools;
(d) the reasons for non-implementation of RTE provisions; and
(e) list of schools implementing and admitting students under RTE in Karur district of Tamil
Nadu?

(a) to (d): The Right of Children to Free and Compulsory Education Act, 2009, mandates the
appropriate Government to provide free and compulsory elementary education to every child
of the age 6 to 14 years in a neighbourhood school. Section 12(1)(c) of RTE Act, 2009
provides for admission of children belonging to weaker sections and disadvantaged groups in
the neighbourhood schools in Class I (or earlier) to the extent of at least 25 percent of the
strength of that class.
Section 11 of the Right of Children to Free and Compulsory Education (RTE) Act,
2009 provides that in order to prepare children above the age of three years for elementary
education and to provide early childhood care and education for all children until they
complete the age of six years, the appropriate Government may make necessary arrangement
for providing free pre-school education for such children.
For implementation of Section 12(1)(c) of the RTE Act, the respective State and UT
Government which is the appropriate government under the RTE Act, are required to notify
the disadvantaged groups and weaker sections, notify per child cost and start admissions in
private un-aided schools as per the procedure laid down by the concerned State and UT
Government.
The Central Government has been supporting States and UTs for implementation of
various provisions of the Act including expenditure incurred towards reimbursement to
private schools for admissions of children under Section 12(1)(c) from 2014-15. The support
is provided on the basis of per-child cost notified by the concerned State and UT for children
in class 1 and above.
The Department of School Education & Literacy has launched an Integrated Scheme
for School Education-Samagra Shiksha by subsuming the erstwhile Centrally Sponsored
Schemes of Sarva Shiksha Abhiyan (SSA), Rashtriya Madhyamik Shiksha Abhiyan (RMSA)
and Teacher Education (TE) from 2018-19. It envisages the ‘school’ as a continuum from
pre-school to Senior Secondary level for providing quality education and conducive learning
environment.
Further, as per Section 7(1) of the RTE Act, 2009, The Central Government and the
State Government shall have concurrent responsibility for providing funds for carrying out
the provisions of this Act.
(e): The list of schools implementing and admitting students under RTE in Karur district of
Tamil Nadu, as provided by the Government of Tamil Nadu, is at Annexure.
