STATEMENT REFERRED TO IN REPLY TO PARTS (a) AND (b) OF STARRED QUESTION NO.377 BY DR.(SMT.) C. SUGUNA KUMARI TO BE ANSWERED IN LOK SABHA ON 23.12.1999 REGARDING ENQUIRY INTO GAISAL TRAIN ACCIDENT.

(a) Preliminary Report of the inquiry conducted by Chief Commissioner of Railway Safety (CCRS) was submitted on 16.8.99. Thereafter, with issue of notification for Judicial Inquiry, CCRS inquiry into the above accident has been terminated. In his Preliminary Report, CCRS had attributed the cause of accident to “Failure of Railway Staff”. However, he had not fixed individual responsibility. Justice G.N. Ray, retired Judge of the Supreme Court of India, has been appointed as one man Inquiry Committee to inquire into the above accident. Judicial Inquiry is presently in progress. Outcome of the inquiry would be known after completion of inquiry and submission of report. Meanwhile, CBI is also conducting an inquiry into the above accident to establish whether there was any criminal intent behind failure of railway staff.

(b) Action against erring officials would be taken after report of Judicial Inquiry and CBI report are received.
