Question : Missing Persons

(a) whether cases of missing of men, women and children and incidents of such women/children being forced into flesh trade, begging and organ trafficking have increased in the country;

(b) if so, the details thereof and the number of such cases registered, persons traced/untraced, gangsbusted, guilty persons arrested and the steps taken to trace all persons during each of the last three years and the current year, State/ UT-wise including Kerala;

(c) the total number of such cases including child trafficking pending in various courts and the steps taken to clear all cases;

(d) whether the Government has identified the reasons behind such increase and if so, the details thereof;

(e) the total number of FIR registered on missing children and disposed of during the said period, State and UT-wise;

(f) whether it is a fact that various States are seen as the hub of trafficking in women and children and if so, the details thereof and the action taken in this regard along with steps taken to rehabilitate the victims; and

(g) the other measures taken by the Government to stop such cases along with the details of advisories issued to States and police departments in this regard?

(a) to (d): National Crime Records Bureau (NCRB) does not maintain data in this regard. However, State/UT wise number of male, female and children kidnapped or abducted for begging and prostitution during 2012-2014 is enclosed at Annexure–I.

(e): There is no specific section of IPC/ SLL for registration of FIR for missing children. As per Hon’ble Supreme Court direction, cases of missing children are to be registered as deemed kidnapping under section 363 of IPC. However, as per data collected from States/ UTs, State/UT wise cases registered, cases charge-sheeted, cases convicted, persons arrested, persons charge-sheeted and persons convicted under kidnapping and abduction of children (Section 363, 364, 364A, 365-369 IPC) during 2012-2014 is enclosed at Annexure-II. Latest annual data pertains to the year 2014.

for trial, persons arrested, persons charge-sheeted and persons convicted under total human trafficking (includes trafficking of women) and child trafficking during 2012-2014 is enclosed at Annexure-III & IV respectively.

(g): As per the seventh schedule to the Constitution of India `Police` and `Public Order` are State subjects and, as such, the primary responsibility of prevention, detection, registration, investigation and prosecution of crime, lies with the State Governments/ Union Territory Administrations.
