Question : Misuse of Domestic Violance Act

(a) whether the Government has made any study on the impact of the Protection of Women from Domestic Violence Act, 2005, if so, the details and the outcome thereof;
(b) whether the Government has taken note of news-papers report of many false cases filed by the wives against husbands and their relatives to settle the score and if so, the total number of such cases reported in this regard during the last three years and the current year, State/UT-wise;
(c) the steps taken by the Government to stop misuse of this act in future; and
(d) whether there is any proposal to amend the Act to stop misuse of this Act and if so, the details thereof?

(a) No study on the impact of implementation of Protection of Women from Domestic Violence Act, 2005 has been carried by Ministry of Women & Child Development.

(b) &(c) Some Newspapers have reported regarding misuse of laws and legal provisions intended for protection of women. Adequate safeguards are available under existing laws to deal with misuse of legal provisions, if any.
(d) There is no proposal under consideration to amend the Protection of Women from Domestic Violence Act, 2005.
