Answer given by the minister

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS
(SHRI HANSRAJ GANGARAM AHIR)

(a) to (d): ‘Police’ and ‘Public Order’ are State subjects under the Seventh Schedule to the Constitution of India. The responsibility to maintain law and order and protect life and property rests with the respective State Governments. The State Governments are competent to deal with such offences under the extant provisions of laws. Advisories have been issued by the Ministry of Home Affairs to States/ UTs from time to time, which are available in the Ministry’s website, viz., www.mha.gov.in. These, inter-alia, clearly require the State Governments/ UTs to maintain law and order and ensure that any person who takes law into his/her own hands is dealt with promptly, and punished as per law. States have been advised that there should be no tolerance at all for such persons and full majesty of law must come to bear on them, without exception.
