Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether the Government has taken note of the adverse observations made by the High Court in the recent past on the ability of the Food Safety and Standard Authority of India (FSSAI) to test quality and standards of food;

(b) if so, the details thereof and the reaction of the Government thereto; and

(c) the remedial measures taken by the Government in this regard?

(a) to (c): The Hon’ble High Court of Bombay in its Order dated 13.08.2015 in Writ Petition (L) No.1688 of 2015 filed by M/s Nestle India Limited, has, inter alia, held that the Food Laboratories where the samples of maggi noodles were tested were not accredited and recognized laboratories. The Food Safety and Standards Authority of India has filed a Special Leave Petition in the Hon’ble Supreme Court against the aforesaid order in respect of certain issues and the matter is sub-judice.
