Question : WAKF TRIBUNALS



(a) whether the Government have decided to constitute Wakf Tribunals in all States and Union Territories to take care of Wakf properties and fix Imams salaries;

(b) if so, the number of States and Union Territories where these tribunals are not in existence; and

(c) the time by which this exercise will be completed?

(a) As per Section 83 of the Wakf Act, 1995, the State/UT Governments have to constitute the Tribunals in their respective States/UTs for the determination of any dispute, question or other matter relating to a Wakf or Wakf property under this Act.

(b) & (c) The following States/UTs have not yet constituted the Wakf Tribunals :-

(1) Arunachal Pradesh

(2) Assam

(3) Goa

(4) Mizoram

(5) Nagaland

(6) Sikkim

(7) Daman& Diu

Of the above 7 States, there is negligible Muslim population/Wakf properties in Arunachal Pradesh, Mizoram, Nagaland, Sikkim and Daman & Diu. Government of Assam has taken up the matter with the Guwahati High Court for constituting the Wakf Tribunals. In the State of Goa due to absence of records of Wakf properties in the State, the State Government does not feel the need for any Tribunal.
