Question : Crimes against Women and Children

(a) whether criminal offences including attack, attrocities, harassment and crimes against women and children including minor girls are on the rise in the country;

(b) if so, the total number of such cases reported/registered, accused arrested/ convicted, cases solved/unsolved, conviction rate achieved and the steps taken to solve the pending cases and to improve the conviction rate of such cases along with the action taken against the guilty separately during each of the last three years and the current year, State and crime-wise including child abuse, rape/gang-rape, molestation, eve-teasing, kidnapping and murder;

(c) whether the Government has assessed/conducted any study to identify the reasons behind the spurt in crimes against women and children and if so, the details and the outcome thereof; and

(d) the other measures taken by the Government to stop such cases in future and the details of advisories, issued to States and Police Department in this regard?

(a) to (d): As per the information provided by the National Crime Records Bureau (NCRB), a total of 3,09,546, 3,37,922 and 3,27,394 cases were registered under crimes (which includes atrocities & harassment) against women during 2013, 2014 and 2015 respectively, showing an increase of 9.2% during 2014 over 2013 and a decrease of 3.1% during 2015 over 2014. A total of 58,224, 89,423 and 94,172 cases were registered under crimes (which includes attack, atrocities & harassment) against children including minor girls during 2013, 2014 and 2015 respectively, showing an increase of 53.6% during 2014 over 2013 and an increase of 5.3% during 2015 over 2014. The increase of 53.6% during 2014 over 2013 is due to the addition of crime heads viz. Assault on women (girls children) with intent to outrage her Modesty, Insult to the Modesty of Women (Girls Children), Importation of Girls from Foreign Country, Transplantation of Human Organs Act, 1994, Child Labour (Prohibition & Regulation) Act, 1986, Immoral Traffic (Prevention) Act, 1956, Juvenile Justice (Care and Protection of Children) Act, 2000, Protection of Children from Sexual Offences Act, 2012, Attempt to commit Murder, Unnatural Offences

(section 377 IPC) and Human Trafficking (section 370 & 370A IPC) in 2014. State/UT-wise and crime-head-wise detailed data on crimes against women and children is enclosed as Annexure-I, I-A, II, III, III-A, IV & IV-A respectively.
As per the Seventh Schedule to the Constitution of India, “Police” and “Public Order” are State subjects and, as such the primary responsibility of prevention, detection, registration, investigation and prosecution of crime lies with the States/UT Administrations.
Ministry of Home Affairs has issued advisories on 04.09.2009, 14.7.2010, 5.1.2015, 20.4.2015 and 12.05.2015 on Crime against women and crime against children, to all State Governments/UTs. These advisories specifically direct the States/UTs that cases should be thoroughly investigated and chargesheets against the accused persons should be filed within three months from the date of occurrence, without compromising on the quality of investigation. Speedy investigation should be conducted in heinous crimes like rape, murder etc. The medical examination of rape victims should be conducted without delay.
