Question : Institutional Capacity to Implement Motor Vehicles Act- 2019

(a) the name of States that have not opted to implement the Motor Vehicles Act, 2019;

(b) whether the Government agencies in the country have optimum institutional capacity to enforce the said act in letter and spirit and if so, the details thereof and the steps taken by the Government in this regard; and

(c) whether the Government has taken any steps with regard to road designs like lane width, shoulder presence, number of lanes, and median design that influence driving for road safety and if so, the details thereof?

(a) The Ministry has not received any information from any State that have not implemented the provisions of the Motor Vehicles (Amendment) Act, 2019.

(b) The Motor Vehicles (Amendment) Act, 2019 provides for provisions for the use of information technology, electronic monitoring and enforcement and delegation of functions to officers by the State Government for effective implementation of the Act.

(c) National Highways are designed, constructed and maintained as per Indian Roads Congress (IRC) codes/guidelines and Ministry’s specifications. Various safety measures such as foot over bridges, underpasses, pedestrian crossings, adequate sight distance, turning radius, rumble strips, including presence of median shoulder etc., as per IRC guidelines, are made as an integral part of the highway development projects depending upon the site requirement and availability of lands etc.
