Question : Mob-Mobilization

(a) whether the Government is aware that mobmobilization has become a routine feature to stage protest in the country;

(b) if so, whether the Government has taken any steps to check such mob-mobilization so that nobody could incite violence taking advantage of it;

(c) whether the Government has taken steps to initiate strict action against the goons who provoke the crowd for violence during such mob-mobilization;

(d) if so, the details thereof;

(e) whether the Ministry has issued advisory to all States and Union Territories time and again to maintain law and order situation and immediately penalize people who violated the laws;

(f) whether there is a wide perception that people guilty of empirical crimes are usually let off and such perception gives scope to other persons committing heinous crimes such as rape, child lifting and cow slaughter etc. going scot free; and

(g) the steps being taken to improve the condition of police forces?

(a) to (f): ‘Public Order’ and ‘Police’ are State subjects as per Schedule VII to the Constitution of India and the State Government concerned is primarily responsible for maintenance of law and order in the State and to

take action against the culprits as per law. The Central Government monitors the law and order situation in the States and assists the State Governments in case of major law and order problem by deploying Central Armed Police Forces (CAPFs) on the request of State Governments.

Government of India attaches utmost importance to upholding the rule of law. Accordingly, Ministry of Home Affairs has, from time to time, issued advisories to States/ UTs for maintenance of public order and prevention of crime in their areas of jurisdiction. These advisories are available in the Ministry’s website: www.mha.gov.in.

(g): Police reforms are an ongoing process. As “Police” is a State subject falling in List-II (State List) of Schedule VII to the Constitution. It is primarily the responsibility of the State Governments/ UT Administrations to implement police reforms measures to make police efficient, capable and also to make functioning of police more effective and transparent. The Central Government issues advisories to the States to bring in requisite reforms in Police administration to meet expectations of the people.

Under the scheme of “Assistance to States for Modernisation of Police”, to supplement the efforts of the States, assistance is provided to the State Governments for equipping and modernizing of their police forces.
