Question : Registration of New Borns

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether the Government is considering to crack the whip on unscrupulous nursing homes and hospitals that do not register children born to unwed mothers or parents not desiring a child;

(b) if so, the details thereof;

(c) whether the Government is considering to make it mandatory for these unscrupulous nursing homes and hospitals to register the birth of children within a time period; and

(d) if so, the details thereof?

(a) & (b): Health is a State subject. Taking action against such nursing homes and hospitals that do not register children born to unwed mothers or parents, not desiring a child, falls within the remit of respective State/UT Government.
(c) & (d): The registration of births and deaths is mandatory under the provisions of Registration of Birth and Death (RBD) Act, 1969. The rules under the RBD Act 1969 have been framed by the concerned State Governments. As per the provisions of the said Act, in case a birth or death occurs in a Medical Institution, it is the responsibility of the Medical Officer-In-Charge of the institution concerned or any person of the institution authorized by him to report the event to the concerned Registrar. In case of Government hospitals, registration units have been opened for registering the birth and death events. The Registrars are required to register every event which occurs under their jurisdiction and 21 days have been prescribed for reporting the event. The responsibility for executing the provisions of RBD Act, 1969 and the Rules and orders made there under lies with the State Governments.
