Question : Reservation for Disabled Persons

(a) the percentage of reservation of Persons with Disabilities (PwDs) in Civil Service Examinations (CSE) and other examinations for Central Government jobs;

(b) the number of Physically Handicapped (PH) candidates who have not been selected by UPSC after clearing the CSE and in other examinations conducted by the central recruitment agencies during the last three years and the reasons therefor;

(c) whether the Apex Court has recently given direction on the issue of reservation in promotion for disabled persons in Government offices and if so, the details thereof; and

(d) the details of persons with disabilities being recruited and given promotion on the basis of reservation in various Central Government Ministries/ Departments during the last two years and current year?

(a): As per the existing instructions dated 29.12.2005, reservation to the differently abled persons in the matter of promotion/recruitment to various categories of posts in government offices is as below:
(i) Three percent of the vacancies in case of direct recruitment to Group A, B, C and D posts shall be reserved for persons with disabilities of which one per cent each shall be reserved for persons suffering from (i) blindness or low vision, (ii) hearing impairment and (iii) locomotor disability or cerebral palsy in the posts identified for each disability;
(ii) Three percent of the vacancies in case of promotion to Group D and Group C posts in which the element of direct recruitment, if any, does not exceed 75%, shall be reserved for persons with disabilities of which one percent each shall be reserved for persons suffering from (i) blindness or low vision, (ii) hearing impairment and (iii) locomotor disability or cerebral palsy in the posts identified for each disability.

(b): Union Public Service Commission has informed that the number of physically handicapped candidates recommended during last 3 years who have cleared Civil Services Examination (CSE) is given below:

Staff Selection Commission has informed that in respect of various examinations conducted by them during the years 2012, 2013 and 2014, the number of physically handicapped candidates selected were 411, 841 and 638 respectively. Ministries/Departments issue appointment letters to the selected or recommended candidates for appointment. Materialization of appointment in some cases take time due to various reasons like non-joining of candidate, delay in joining, procedural formalities like police verification etc.
(c): The Hon’ble Supreme Court have been giving direction from time to time but in its Order dated 01.09.2015 in the Contempt Petition No.499/2014 in Civil Appeal No. 9096/2013 and the Application for Clarification filed by this Department, inter-alia, made the following observations:
(i) The judgment of 8.10.2013 of the Hon’ble Supreme Court in Civil Appeal No. 9096/2013 relates to the manner of computing 3% reservation for the PWDs and on the aspect whether post based or vacancy based reservation must be adhered to;
(ii) Para 51 of the judgment of 8.10.2013 directed that the manner of identification of vacancies must be uniform in the case of all the groups viz. A, B, C and D.
(d): As per details uploaded by various Departments/Ministries, the number of persons with disabilities appointed were as under:
