Question : DUTY EXEMPTION FOR IMPORT OF MATERIALS USED IN KNEE SURGERY



(a) whether the prosthesis consisting of an alloy cap and ultra-high molecular weight polyethylene plastic used in case of knee-joint replacement surgery is imported from USA and other countries.

(b) whether such organs and medical inputs are exempted from duties; if so, the details thereof; and

(d) the conditions and circumstances under which import of such items is exempted from duties

Answer given by the minister

(a) Yes Sir.

(b),(c)&(d): Yes Sir. All instruments and implants for severely physically handicapped patients and joints replacement and spinal instruments and implants including bone cement are exempt from all import duties unconditionally under notification No. 16/2000-Customs, dated the 1st March, 2000 read with notification No.6/2000-Central Excise, dated the 1st March, 2000. Prosthesis for knee-joint replacement surgery is also eligible for the aforesaid exemption.
