Question : PROMOTION OF SC ST EMPLOYEES



(a) whether Article 16(4A) of the Constitution as amended by the Constitution (85th Amendment) Act, 2001 provides for promotion of SC/ST employees in Government Services;

(b) if so, the details thereof;

(c) whether the employees belonging to the SC/ST communities of Jharkhand State Civil Service were denied promotions to the Indian Administrative Service;

(d) if so, the details thereof; and

(e) the steps taken by the Union Government in this regard?

(a) & (b) : Yes, Madam. The 85th Amendment, enables the State to make provision of reservation in the matter of promotion, with consequential seniority, in favour of SCs and STs.

(c) : No, Madam. Promotion of State Civil Service officers to Indian Administrative Service takes place in accordance with Indian Administrative Service

(Appointment by Promotion) Regulations, 1995.

(d) & (e) : Does not arise.
