Question : Governor and Chief Justice Office under RTI

(a) whether it is a fact that the office of the Chief Justice of India and the Governors are not covered under the Right to Information (RTI) Act;
(b) if so, the details thereof and the reasons therefor;
(c) whether the Supreme Court of India has made observation for bringing these offices under the RTI;
(d) if so, the details thereof; and
(e) the action taken by the Government in the light of the Supreme Courts’ observation?

(a) & (b): The Office of Chief Justice of India and Governor are not recorded as Public Authority on the records of Central Information Commission.

As per Section 2(h) of Right to Information Act, 2005 a "public authority" means any authority or body or institution of self-government established or constituted—

(a) by or under the Constitution;
(b) by any other law made by Parliament;
(c) by any other law made by State Legislature;
(d) by notification issued or order made by the appropriate Government,
and includes any—
(i) body owned, controlled or substantially financed;
(ii) non-Government organisation substantially financed,
directly or indirectly by funds provided by the appropriate Government.

(c) to (e): No such observation is available in the record.
