Question : CASES OF NHAI



(a) whether large number of cases of NHAI involving road contracts are under arbitration;

(b) if so the details thereof along with the present status thereof along with the funds involved in such cases; and

(c) the steps taken by the Government for their early settlement?

THE MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (SHRI PON. RADHAKRISHNAN)

(a) and (b) 112 no of cases involving Rs. 25,398.76 crores are pending under Arbitration between National Highways Authority of India (NHAI) and the Contractor/Concessionaire(s). Details of pending cases alongwith the amount involved therein is placed at Annexure.

(c) NHAI has set up a high level Independent Settlement Advisory Committee (ISAC) under the Chairmanship of Former Justice Delhi High Court for one time settlement of old cases pending with the various Courts of Law. The settlement/ negotiation is carried out by another Committee comprising 3 Chief General Managers of NHAI. Thereafter, the matter is placed before ISAC. Depending on the amount involved, the recommendations of the ISAC are placed before NHAI Board /Executive Committee of NHAI for final approval of settlement.
