(a) whether the Government is aware of Constitutional amendment of article 16 (4A) and subsequent DOP OM No.20011/1/2001-Estt.

(d) dated January 21, 2002;

(b) if so, whether the said circular had been implemented with retrospective effect from January 30, 1997;

(c) if so, the details thereof; and

(d) if not, the reasons therefor?
