Question : Crime against Women and Children

(a) whether criminal offences including atrocities and crimes against women and children are on the rise in the country;

(b) if so, the total number of such cases reported/registered, accused arrested/ convicted, cases solved/unsolved, conviction rate achieved and the steps taken to solve all the pending cases and to improve the conviction rate of such cases along with the action taken against the guilty separately during each of the last three years and the current year, State and crime-wise including child abuse, rape/gang-rape, molestation, eve-teasing, dowry death, kidnapping, acid attack and murder;

(c) whether the Supreme Court has issued any directive to control crime against women and if so, the details thereof and the action taken by the Government in this regard;

(d) whether the Government has assessed/conducted any study/reviewed the reasons behind the spurt in criminal offences including crime against women and children and if so, the details and outcome thereof;

(e) whether the Government has any proposal to formulate a new law or amend the existing laws to check such cases in the country and if so, the details thereof; and

(f) the details of advisories issued to the States and Police Departments in this regard along with the other measures taken by the Government in consultation with the State Governments to check such cases and provide security and safety to women and children in the country including in public transport and at the work places?

(a) & (b) : A total of 38172, 58224 and 89594 cases were reported in the country under crime against children during 2012, 2013 and 2014 respectively, showing a rising trend. Similarly, a total of 244270, 309546 and 334188 cases were reported in the country under crime against women during 2012, 2013 and 2014 respectively, showing a rising trend.

Crime Head wise cases registered, cases charge sheeted, cases convicted, cases conviction rate, cases pending for trial, persons arrested, persons charge sheeted and persons convicted under crime against children and women during 2012-2014, is given at Annexure-I & II respectively. (c) to (f): The Supreme Court has directed in respect of W.P. (Criminal) No. 129 of 2006 in the case of Laxmi (minor) to provide compensation to acid attack victims. An advisory dated 27-04-2011 has been issued to all State Governments/Union Territory Administrations advising them to keep in view the direction of the Hon’ble Supreme Court.

Ministry of Home Affairs has issued advisories on 04.9.2009, 5.1.2015 and 12.5.2015 on Crime Against Women and Crime against Children to all State Governments/UTs. These advisories have advised State Governments to adopt appropriate measures for swift and salutary punishment to the persons found guilty of violence against women and children, set up Fast Track Courts, Family Courts, Crime Against Women/Children desks in each Police Station, improve the quality of investigations, minimize delays in investigations of crime against women and children and to undertake gender sensitization of the police personnel. These advisories specifically direct the States/UTs that “cases should be thoroughly investigated and chargesheets against the accused persons should be filed within three months from the date of occurrence, without compromising on the quality of investigation. Speedy investigation should be conducted in heinous crimes like rape, murder etc. The medical examination of rape victims should be conducted without delay. As per the Seventh Schedule to the Constitution of India, “Police” and “Public Order” are State subjects and, as such the primary responsibility of prevention, detection, registration, investigation and prosecution of crime lies with the States/UT Administrations.
