Question : Cases against Rohingyas

(a) the total number of FIRs filed against Rohingyas in the country, for offences under Chapter VI of the Indian Penal Code and for terror related crimes;

(b) the total number of long-term visas issued by the Government for Rohingyas in the country;

(c) whether the Ministry makes a distinction between an illegal migrant and a refugee;

(d) if so, the details thereof;

(e) if not, the reasons therefor;

(f) the details of the law under which the Government is dealing with requests for asylum from Rohingyas and others; and

(g) the total number of Rohingyas deported or facing deportation to Myanmar?

(a): Data on FIRs filed against Rohingyas is not Centrally maintained.
(b): Community/ Religion wise data on issuance of Long Term Visas is not maintained. However, as per available information a total of 884 Long Term Visas were issued to Myanmar Nationals as on 31.12.2017.

(c) to (f): ‘illegal migrant’ as defined under Section 2 (1) (b) of the Citizenship Act, 1955, means a foreigner who has entered into India- (i) without a valid passport or other travel documents and such other documents or authority as may be prescribed by or under any law in the behalf; or (ii) with a valid passport or other travel documents and such other documents or authority as may be prescribed by or under any law in that behalf but remains therein beyond the permitted period of time. India is not a signatory to the 1951 United Nations Convention relating to the status of Refugees and the 1967 Protocol thereon. There is no national law dealing specifically with refugees at present. All foreign nationals including asylum/ refuge seekers are governed by the provisions contained in The Foreigners Act, 1946 and The Passport (Entry into India), Act, 1920 and rules & orders made thereunder.
(g): Detection and deportation of illegal immigrants is a continuous process and is reliant upon nationality verification by the concerned foreign Government. As per information available, 12 Myanmar nationals were deported recently after following due process.
