(a) As per data compiled by National Crime Records Bureau at the end of 2009, 2010 and 2011,
a State/UT wise statement showing number of undertrials in various jails of the country is at
Annexure-I and a State/UT wise statement showing number of undertrials released/transferred is
at Annexure-II.
(b) & (c) âPrisonsâ is a State subject under Entry 4 of List II of the Seventh Schedule to the
Constitution, and Prison Administration is primarily the responsibility of the State Governments.
As per data compiled by National Crime Records Bureau at the end of 2011, a State/UT wise
statement of undertrials in various jails of the country for more than 5 years is enclosed at
Annexure-III.
(d) Fast Track Courts were set up on the recommendations of 11th Finance Commission as
one-time measure for disposal of long pending sessionâs cases involving undertrial prisoners,
for a period of 5 years first from 2000 to 2005. The period was extended by another 5 years
from 2005-2010 and further extended by one more year i.e., 2010-11 by the Government. The
Government had provided financial assistance to the State Governments for Fast Track Courts
from 2000-01 to 2010-11.
