Question : DRIVING LICENCES



(a) whether the Government proposes to cancel the driving licences of repeated offenders and enhance the quantum of punishment;

(b) if so, the details thereof;

(c) whether several instances of use of fake driving licenses have been reported to the country;

(d) if so, the details thereof; and

(e) the steps taken by the Government in this regard?

(a) & (b) Provisions regarding offences, penalties and procedure are contained in Sections 177 to 210 of Chapter XIII of Motor Vehicles Act, 1988 (MV Act) and rule 164 of Central Motor Vehicles Rules, 1989 (CMVRs). Provisions for enhancement of penalties are already provided in the MV Act for successive offences.

(c) to (e) Implementation of provisions of MV Act and CMVRs comes under the purview of State Transport Departments. Section 19(1)(e) of MV Act provides for disqualifying a person for a specified period for holding or obtaining any driving licence to drive or any class of description of vehicles specified in the license or revoke such license if a Licensing Authority is satisfied after giving holder of a driving licence being heard, that he has obtained any driving licence or a license to drive a particular class or description of a motor vehicle by fraud or misrepresentation.
