Question : Detention Centres

(a) whether the Home Ministry has issued a Model Detention Centre Manual to the States;

(b) if so, the details thereof;

(c) the number of operational detention centres in the country and the number of detention centres being constructed, State/UT-wise;

(d) the number of individuals currently detained in these centres, State/UT-wise and the capacity of operational and under construction detention centres;

(e) whether the Government expects the number of detainees to increase after the implementation of CAA and NRC and if so, the details thereof, including the estimated increase in detainees;

(f) whether the Government has asked State Governments to set-up detention centres in their respective States; and

(g) if so, the details thereof?

Ministry of Home Affairs had prepared a Model Detention Centre/Holding Centre/Camp Manual in consultation with various stakeholders and this was circulated to all State Governments/ UT Administrations on 09.01.2019 for implantation. The Model Manual covers legal provisions with regard to detention and deportation of a foreign national, instructions issued by the Ministry of Home Affairs in this regard from time to time, categories of persons who may be detained and the amenities to be provided in the Detention Centres/ Holding Centres/ Camps.
(c) to (g): In pursuance of the order at 28.02.2012 by the Hon’ble Supreme Court in W.P. (Crl.) no. 310 of 2005, Ministry of Home Affairs issued instructions on 07.03.2012 to State Governments and UT Administrations to comply with the said directions of the Hon’ble Court. Detention Centres are set up by State Governments/ Union Territory Administrations as per their requirement to detain illegal immigrants/ foreigners who have completed their sentence pending their deportation to their native country. Details of number of detention centres set up by the State Governments/ Union Territory Administrations along with their capacity and number of foreign nationals detained in these detention centres are not centrally maintained.
