STATEMENT REFERRED TO IN REPLY TO PARTS (a)TO (c) OF LOK SABHA STARRED QUESTION NO.234 DUE FOR ANSWER ON 08.08.2000.

(a): As per information made available by the National Human Rights Commission (NHRC), the number of deaths in custody during the last three years i.e. 1997-98, 1998-99 and 1999-2000 was 1012, 1297 and 1143 respectively. The details of custodial deaths in police and judicial custody during the period under reference are given in the enclosed statement.

(b): Although `Police` is a State subject, the Government of India have issued guidelines to the State Governments, from time to time, to ensure that police behave in an humane manner and that cases of alleged custodial deaths and police excesses are enquired into and dealt with firmly, wherever they occur. Special emphasis is being laid on human rights in the training curricula of police personnel at all levels. `Induction` and `in-service` training programmes also include special inputs to sensitise police personnel about the use of scientific methods for investigation.

(c): NHRC had directed the State Governments to pay compensation in 47 cases on account of custodial death to the dependents of the victims during the last three years.
