Question : Encroachment on Defence Land

(a) whether cases related to unauthorised construction/encroachment and poor management of lease of the land falling under the Defence Estate Organization Management have come to the notice of the Government during the last three years and the current year;
(b) if so, the number of such cases that came to light during each of the last three years, State/UT-wise along with the area of defence land encroached upon in the country in such cases;
(c) the State/UT-wise number of such cases in which the unauthorised construction/encroachment has been removed during the said period;
(d) the number of encroachers penalised; and
(e) the mechanism set up by the Government to save the defence land of the country from such unauthorised construction/encroachment along with the steps taken/being taken in this regard?

(a) & (b) The Ministry of Defence is managing its land as per existing land policy and related guidelines/ rules. There is strict vigil to prevent unauthorised construction/ encroachment of defence land. The State/UT-wise details of such unauthorised constructions/ encroachments during the last three years alongwith current year (upto 30.09.2019) are enclosed as Annexure-A.
(c) & (d): The State/UT-wise number of such cases in which the unauthorised construction/ encroachment has been removed and the number of encroachers penalised during the last three years alongwith current year (upto 30.09.2019) are enclosed as Annexure-B.
(e) There is a mechanism in place to check the unauthorised occupation/ encroachment on defence land and following steps are taken in this regard:

(i) Respective user Services who manage defence land are responsible for its protection, removal of encroachments and planning for its land use.
(ii) Strengthening of Defence land management by way of computerisation and digitisation of land records; Survey, demarcation and verification of defence lands and land Audit.
(iii) Regular inspection of sites under respective jurisdiction is conducted by the CEO /DEO / Station Commander as the case may be.
(iv) Issue of detailed instructions by the Government emphasising the need for ensuring vigilance, detection and prevention of new encroachments.
(v) Removal of encroachments on defence land under the provisions of Public Premises (Eviction of Unauthorised Occupants) Act, 1971 as well as under the Cantonment Act, 2006.
