Question : Illegal Construction in Delhi

(a) whether the Court has made an observation regarding 90 per cent of illegal construction in Delhi;

(b) if so, the action taken by the Government in this regard;

(c) the reasons for not taking action against the officers due to whose negligence the illegal construction has taken place/is taking place; and

(d) the various provisions laid down in this regard?

(a) & (b): The North, South and East Delhi Municipal Corporations have informed that the Hon’ble Courts have made various directions from time to time to curb the menace of illegal construction in Delhi. Besides, Hon’ble Supreme Court has revived the Monitoring Committee under the chairmanship of Vice Chairman, DDA to ensure action against unauthorised construction and encroachment on Government land. The directions of Hon’ble Courts are followed in letter and spirit. As and when any unauthorised construction is noticed in any of the DMC area, action is taken by the Building Department of the respective zone as per provisions of DMC Act, 1957. Similarly, action against unauthorised construction under various provisions of Cantonment Act, 2006 and Public Premises (Eviction of Unauthorised Occupants) Act, 1971 is taken in Delhi Cantonment Board area as well.

(c) & (d): Regular Departmental Action (RDA) against the delinquent officials is taken as and when any complaint is received against them. The action under Sections 343, 344 and 345-A of DMC Act is initiated in case any illegal construction is noticed in the areas under the jurisdiction of all the three DMCs. DMC Act, 1957 has the provisions of action against illegal construction and CCS (Conduct) Rules, Pension Rules and DMC Services (Control and Appeal) Regulations have the provision for action against officials held responsible for lapse towards duty.
