Question : Monitoring and Repairing of Roads

(a) whether the National Highways Authority of India (NHAI) has directed all its officials to strictly monitor road conditions and take timely action for repairing the damaged stretches;

(b) if so, the details thereof;

(c) whether damages would be levied and appropriate action would be initiated against the contractor, if he fails to fulfil the contractual obligations of operations and maintenance; and

(d) if so, the details thereof?

(a) & (b) Sir, supervision of works is being done through Authority Engineer/ Independent Engineer/ Supervision Consultants. National Highways Authority of India (NHAI) has modified Terms of Reference (ToR) for supervision consultants to include equipment based inspection and also devised a reporting system to be followed by them. Regular reporting of the damages /deficiencies is being included in the ToR in order to take timely action.

(c) & (d) If Contractor/Concessionaire is at default in fulfilling its obligations, penalty/damages are imposed under the provisions of the agreement.
