STATEMENT REFERRED TO IN REPLY TO PARTS (a),(b),(c),(d),(e),(f) and (g) OF THE LOK SABHA QUESTION NO.290 DUE FOR ANSWER ON 16-08-2004 IN THE LOK SABHA.
(a): The powers for implementation of the Edible Oil Packaging (Regulation) Order, 1998 have been delegated to the State Governments. Since the inception of the said Order, Government regularly monitors its implementation status and interacts with the State Governments at various levels.
(b) to (d): The status of the implementation of the said Order State-wise and oil-wise is annexed.
(e): The State Governments have been frequently advised to enforce the implementation of the said Order.
(f) & (g): The responsibility of conducting inspections and prosecution under this order is vested in the State Governments.

STATE/UT STATUS OF IMPLEMENTATION
ANDHRA PRADESH Has recommenced implementation after vacation of the stay order by the H.C. vide CCS. Ref.No. PI(3)/652/2000 dated 23.05.02. Copies of Regn. Certificates are being received.
DELHI Has initiated implementation vide Notfn.Nos.F.6 (3)/ 98-F&S (P&C)/I to V dt.13.1.2000 Registering Authority, Inspecting Officers and Registration Fee have been notified. Laboratory of PFA & any lab authorized by the State Govt.are notified for analysis of samples.
HIMACHAL PRADESH Has extended the Edible Oil Packaging (R) Order 1998 to whole state vide No.FDS-A(3)-9/90-I-Loose Dt.1.5.2002 & Registering Authority and Inspecting Officers have been notified.
ORISSA Has started implementation vide Notfn. No. 11385 dt. 10.05.99. 21 Registrations have been issued so far.
PONDICHERRY Has republished EOP(R) Order 1998 vide G.O. Ms. No. 19/98 dt.14.10.98. Registering Authority, Inspecting Officers and fee for Registration have been notified.
RAJASTHAN Has started implementation vide Notfn. No. F.17 (10) FS/Legal/98 dt.9.5.2000, Copies of Regn. Certificates issued have been received.
TAMIL NADU Has republished EOP(R) Order 1998 vide G.O. Ms. No. 267 dt.14.12.98 Registrations from the districts of Dharmapuri, Coimbatore, Madurai and Chennai are being received. The State Government has exempted Gingelly oil, Ground nut oil & Coconut oil for a period of one year from 01.01.04 upto 31.12.04

ANDAMAN & NICOBAR exempted all edible oils upto 31.03.1999 vide Notfin No.55-28/98-TR dt.5.2.99
ASSAM is processing the matter of implementation of the order vide No. FSB.216/98/16 dt. 6.2.99
BIHAR has decided not to implement the Order till 31-03-2003 vide Pr.4-V.2-03/98/3697 Dt. 31-08-2001 & letter dt. 11.4.2002
GUJARAT decided to implement the Edible Oil Packaging (R) Order, 1998 vide Notification TLP/1098/4012/D dt. 28.8.2001
HARYANA has kept the matter of implementation of the Order in abeyance vide Letter No. 114-5S-99/704 dt. 8.1.99
JAMMU & KASHMIR exempted all edible oils including those distributed through PDS upto ending December 2002 vide Notfn. No. SRO-03 dt. 3.1.02 read with Notfn. No.SRO-355 dt. 29.12.98 and SRO.211 dt.20.6.2000
KARNATAKA has started implementation in a phased manner exempting some specified oils upto 1.1.2004 & exemption will cease for edible oils w.e.f 1.1.04 vide Notfn No. FCS/149/FCS/98 dt. 02.03.2002.
KERALA has exempted coconut oil from the purview of the VOP (R) Order for a period of 10 years vide Notification S.R.O.No.290/2000 dt. 29.3.00
MADHYA PRADESH has exempted all edible oils up to 30-09-2004 vide Notfn. No. F-4-28/98/29-1 dt. 22.09.2003
MAHARASHTRA has decided to defer implementation of the said order up to 15.7.2000 vide Letter No. ECA 1898/2473/CR 3719/CS-30 dt. 16.10.99
PUNJAB has decided to keep the matter in abeyance for a period of one year more vide Letter No.24/4/98-7FDI/6436 dt 3.8.2001 & yet to implement the order vide Lr. Dt. 22.7.03
TRIPURA Published the order in the state vide Notfn. No. F.2(31)-FSD/94 dt. 2.11.98 & exempted the sales of loose Mustard oil vide Notification No. F.2(31)-FSD/94 dt. 15.12.98.
UTTAR PRADESH Exempted all edible oils upto 30.6.2004 vide No.456/29-Kha-9-2003-201/1998 dt.31.3.2003. The Govt. has not yet implemented the order.
WEST BENGAL has drafted West Bengal Edible Oils Packaging (Regulation) Order, 1999 as an alternative to the above Order and sent to Law Dept. for vetting vide D.O. No. NIL dt. 12.1.2000 from Shri A. Kapur DG& Secy.,F&S.

LAKSHADWEEP has no specific action in implementation of the Order as there is no oil mill/ manufacturer in the U.T. edible oils in packed form is procured from neighboring states, Karnataka & Kerala
MEGHALAYA Has informed that it does not implement the Packaging Order. There is no edible oil-packaging unit in the State.
MIZORAM The Government has informed that there is no Edible Oil manufacturing units as well as registered packer in Mizoram. Oils are brought in tins or cartons or plastic containers.
