Question : CENTRAL LEGISLATION ON ADMISSION TO MEDICAL COLLEGES



(a) whether the Union Government has received a proposal from the Government of Maharashtra for central legislation on admission to Medical Colleges in different States in the light of the Supreme Court`s judgement in TMA Pai case;

(b) if so, the details thereof ;

(c) the action/decision taken on the said proposal ;

(d) the reasons for the delay if any; and

(e) the time by when the Legislation is likely to be brought in by the Union Government?

(a) to (e): A proposal has been received from the government of Maharashtra for enacting a central legislation with regard to the various aspects concerning higher professional education in health sciences. The said proposal is in the nature of a suggestion and no details have been given.


Pursuant to the directions of the Hon`ble Supreme Court dated 31-10-2002 in the T.M.A. Pai Foundation case, the Central Government had issued broad policy guidelines dated 14-05-2003 to the State Governments and the Universities in the matter of admission and charging of fee by the private unaided medical land dental institutions. The Central Government has also decided to frame an appropriate legislation in this regard after eliciting the views of the concerned Departments and the stakeholders including the State Governments.
