Question : Patent of Medicinal Plant-Herbs

(a) whether the American Company Cormark Research Inc. has got brinjal, blackberry, bitter gourd and cow urine patented while medicinal properties of these have been mentioned in the Ayurveda and Veda of our country;

(b) if so, whether any action is being taken by the Government in this regard and if so, the details thereof;

(c) whether the Government proposes to get the patent of medicinal plants and herbs which have been mentioned in Ayurveda and Vedas; and

(d) if so, the details thereof including the medicinal plants/Ayurvedic medicines patented so far?

(a): No patent has been granted for brinjal, blackberry, bitter gourd and cow urine to the American company Cormark Research Inc. in India.
(b): Does not arise.
(c): No.
(d): Patents are not granted for plants as per section 3 of the Patents Act 1970. However, patents have been granted for Ayurvedic/herbal based inventions, the list of which is enclosed at Annexure ‘A’.
