Question : Toll Tax Collection

(a) the criteria/directions for regulation of toll tax collection and the total amount of toll tax collected on the national highways by the developers during the last three years, State and UT-wise;

(b) whether the Government is aware of the large scale complaints from the users of highways regarding collection of toll even before the completion of the project;

(c) if so, the details thereof;

(d) whether the Government has any proposal to revamp toll collection policy to provide major respite to the commuters, if so, the details thereof; and

(e) the steps taken by the Government to have centralised database of toll collections across the country for information of the public?

(a) The User Fee (Toll) at any Toll Plaza on a Build Operate Transfer (BoT) project are worked out based on the applicable fee rules (1997/ 2008) and in accordance with provisions of Concession Agreement. The details of User Fee (Toll) collected on BoT (Toll) projects during last three years are at Annexure-I.

(b) & (c) The user fee at any toll plaza is collected only for the completed length of NH section assigned to the Toll Plaza. Prior to 16.12.2013, for a four lane NH section, which is under tolling, is awarded on BOT (Toll) for upgradation/ development to six lane, the concessionaire collects user fee (Toll) applicable for 4-lane during the construction period also, as there is no difference in base user fee rates for 4 lane and 6 lane. There have some been representations against this provision.

Accordingly, vide G.S.R. 778(E) 16.12.2013, NH Fee Rules 2008 have been amended that the rate of fee for a section of a four-lane highway shall on and from the commencement of the work relating to upgradation to six laning, be seventy-five per cent of the fee applicable on the date of commencement of the National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2013, till the completion of the project without any annual revision.
