Question : Investigation of Cases by CBI

(a) whether the number of cases registered with the Central Bureau of Investigation (CBI) are increasing over the years and if so, the reasons therefor;

(b) the number of cases investigated by the CBI during the last two years and the current year;

(c) the number of cases out of the above that are more than five years old and the reasons for the delay in their disposal;

(d) the details of provisions regarding the timeframe for completion of investigation of cases entrusted to CBI; and

(e) the efforts made to ensure strict compliance of the said provisions?

(a) :- According to information provided by CBI, the number of cases registered during the last 5 years i.e. 2010, 2011, 2012, 2013, 2014 & 2015 (upto 30.11.2015) are as under:-

The increase in registration of cases by CBI is only marginal and as such may not reflect any definite discernible trend. The main reasons for marginal increase in registration of cases are due to larger number of cases referred by Hon’ble Supreme Court, Hon’ble High Courts and State Governments from time to time.

(b): After registration of cases, CBI undertakes investigation of cases as per the prescribed procedure. The number of cases disposed off after investigation/enquiry during the last 2 years i.e. 2013, 2014 and 2015 (upto 30.11.2015) are as under:-

Investigation/enquiry is conducted by CBI as per provisions of Code of Criminal Procedure (Cr.PC) and as per instructions contained in the Crime Manual of CBI. However there are various reasons which cause the pendency. Some of these reasons are (a) stay by the Courts, (b) delay in handing over the cases to CBI for investigation after initial investigation by local police (c) non traceability of accused persons, (d) delay in getting expert opinion (e) large number of cases referred by State Governments, Hon’ble Supreme Court and Hon’ble High Courts (f) complex and voluminous nature of cases (g) delay in execution of Letters Rogatory (LR) with foreign Countries, etc. It is the endeavour of CBI to complete the investigation/enquiry expeditiously and to this effect rigorous monitoring of investigation of cases is done by Central Bureau of Investigation (CBI), Central Vigilance Commission (CVC) etc.
