Question : Appointment of Security Advisors

(a) whether appointment of a security advisor in every industrial company is mandatory, if so, the details thereof;

(b) whether security advisor has been appointed in every company of the country, if so, the details thereof; and

(c) if not, whether the Government proposes to take action against such industries and if so, the details thereof and if not, the reasons therefor?

(a) to (c): No, Madam. The Companies Act, 2013 does not mandate any type of companies including industrial companies to appoint a security advisor. The requirement of security advisor in an Industrial Company is not mandatory under the Petroleum Act, 1934 and Explosives Act, 1884 and rules framed thereunder. However, Licensed Defence Companies, as per the guidelines notified under Defence Security Manual, are required to appoint an Indian Citizen as Company Chief Security Officer, who will be responsible for implementing the Security Architecture in the company as detailed in Security Manual. Further after issue of Industrial License, the company is required to give an undertaking to comply with the provisions of Security Manual. These companies are also subjected to External Security Audit by Intelligence Agencies once in two years and Cyber Security Audit by CERT IN (Indian Computer Emergency Response Team) empaneled auditors once every year.
