Question : Violation of Explosive Substances Act

(a) whether there have been instances of violations of the Explosive Substances Act, 1908 and Explosives Act, 1884 with regards to fireworks and mining explosives in the country;

(b) if so, the details of such cases reported and arrests made during the last three years, State-wise;

(c) the instances of unintended explosions or use of explosives by Maoists due to non-compliance by organisations along with the deaths and injuries caused due to violations of the said Acts during the said period, State-wise; and

(d) the measures taken by the Government to check the violations of the said Acts?

(a): Yes, Madam. 4027, 3875 and 3843 cases of violations of the Explosives Substance Act, 1908 and Explosives Act. 1884 were reported during 2012, 2013 and 2014 respectively. The aggregated data is maintained by the National Crime Records Bureau (NCRB). Hence,

separate data with regards to fireworks and mining explosives are not maintained.

(b): State/UT wise data on cases registered, charge sheeted, cases convicted, persons arrested, persons charge sheeted and persons convicted is at Annexure – I and cases reported and explosives recovered is at Annexure – II.

(c): This Ministry along with concerned Central Agencies/ Organizations regularly monitors the incidents of use and backtrack of explosives by Maoists. Data relating to unintended explosions, accidents taken place in fireworks factories and in explosives manufacturing factories for the period 2013-2016 is at Annexure-III.

(d): As per the second Schedule to the Constitution of India, “Law and Order” are state subjects. However, from time to time, concerned agencies take necessary action to check violation of these Acts.
