Question : National Company Law Tribunal

(a) the number of cases that have been filed with the National Company Law Tribunal (NCLT) since the Insolvency Bankruptcy Code, 2016 was enacted, till date, company-wise;

(b) the number of cases resolved along with the amount of Non-Performing Assets (NPAs) realized till date, company-wise;

(c) the number of corporate debtors put under resolution process;

(d) the number of appellate tribunals and NCLT benches that are functioning in the country at present; and

(e) whether the Government proposes to increase the number of appellate tribunals and NCLT benches in the country to avoid delay of cases, if so, the details thereof and if not, the reasons for the same along with the other corrective measures taken/being taken by the Government for speedy disposal of NCLT cases?

STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (e) OF THE STARRED QUESTION NO. 145 FOR ANSWER IN LOK SABHA ON 27.07.2018:

(a): As per the information furnished by National Company Law Tribunal (NCLT), since enactment of Insolvency and Bankruptcy Code, 2016 , 6,326 fresh cases have been filed before NCLT under the IBC, 2016 and 2,323 winding up cases have been received on transfer from various High Courts till 30.06.2018.

(b)& (c): A total of 4,390 cases have been disposed and 907 cases have been admitted under IBC, 2016 till 30.06.2018 in NCLT. As per the information furnished by Insolvency and Bankruptcy Board of India (IBBI), in 32 companies corporate insolvency resolution process has resulted in realization of Rs. 49784.11 crore.

(d): There is one bench of National Company Law Appellate Tribunal (NCLAT) at New Delhi. Benches of NCLT have been constituted at New Delhi, Allahabad, Ahmadabad, Bengaluru, Chennai, Chandigarh, Cuttack, Gauhati, Jaipur, Hyderabad, Kolkata, and Mumbai.

(e): There is no proposal to increase number of Appellate Tribunals. Benches of NCLT are being established in a phased manner keeping in view the workload. Bench of NCLT is to be constituted at Kochi very soon. For speedy disposal of cases, Government has decided to augment the number of Members. More than one court have been started functioning at benches where number of pending cases is comparatively higher, such as Mumbai and Delhi. Regular colloquiums are being held for Members of NCLT so as to ensure speedier and uniform judicial delivery system.
