Question : Crime against Dalits

(a) whether atrocities and various crime against dalits are on the rise in the country;

(b) if so, the total number of such cases reported, conviction rate and the action taken against the guilty during each of the last three years and the current year, Statewise;

(c) whether the Government has sought report from the States in this regard and if so, the details thereof, State-wise including Maharashtra;

(d) whether there are reports that some anti-social elements are behind these cases, if so, the details thereof and the action taken against them;

(e) whether the Government has conducted any survey to identify the reasons behind such increase, if so, the details and the outcome thereof; and

(f) the other measures taken by the Government to stop such cases and improve the conviction rate in future?

(a) & (b): As per the information provided by the National Crime Records Bureau (NCRB), details of State/UT-wise cases registered, cases charge-sheeted, cases convicted, conviction rate, persons arrested, persons charge-sheeted and persons convicted under total crime/atrocities against

persons belonging to Scheduled Castes during 2014-2016 are given in Annexure-I
(c) to (f): The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been amended in 2015 to make it more effective. This has been done with an aim to deliver greater justice as well as an enhanced deterrent to the offenders against persons belonging to SCs and STs. The amendments include new offences, re-phrased existing sections, expanded scope of presumptions, institutional strengthening, establishing rights of victims and witnesses, and strengthening preventive measures.
‘Police’ and ‘Public Order’ are State subjects under the Seventh Schedule to the Constitution of India. The responsibilities to maintain law and order, protection of life and property of the citizens rest primarily with the respective State Governments. The State Governments are competent to deal with such offences under the extant provisions of laws. However, Ministry of Home Affairs has issued advisories in this regard, which are available at www.mha.nic.in. The Government of India regularly reviews the status in this regard.
As per available information, Government has not conducted any survey to identify the reasons.
